MusoHQ Terms of Use

These terms cover your use of MusoHQ, an invoicing, band payout, and tax record-keeping app for working musicians.

Who these terms are with

MusoHQ is made and sold by Matthew Edwards, ABN 44 523 291 099, a sole trader based in New South Wales, Australia. In these terms, "I", "me" and "my" mean Matthew Edwards, and "you" means the person using the app.

What MusoHQ is for

MusoHQ helps you log gigs, raise invoices, split band payouts, track expenses, and estimate GST and super guarantee on your income. It is a record-keeping and calculation tool. I am not a registered tax agent or BAS agent, and MusoHQ is not a substitute for an accountant or a legal or financial adviser. Nothing in it is tax, accounting, superannuation or financial advice. Every figure it shows is worked out from what you enter, using rates built in at the time of that release, and the rules behind those figures carry conditions the app does not model. You are responsible for checking any figure before you lodge it with the ATO, send it to a client, or pay anyone on the strength of it.

Your data, and other people's

MusoHQ stores everything locally on your device. There is no account and no server, so you are responsible for backing up your own data. The app includes a manual backup and restore feature for this. If you delete the app or lose your device without a backup, your data is gone and I cannot recover it.

Some of what you enter is not your own information. A band member's name, ABN, bank account, or super fund details belong to that person. You are responsible for having a proper reason to hold those details, for keeping them secure, and for dealing with that person if they ask what you hold about them. MusoHQ keeps them on your device and never sends them to me or anyone else. See the Privacy Policy for the detail.

Purchases

MusoHQ is free to use, with a limit on how many invoices you can send. The MusoHQ Pro unlock removes that limit and opens band mode, the Money dashboard and the CSV export. It is a one-time purchase, not a subscription, and it does not expire.

The unlock is processed entirely by Apple through StoreKit. Billing, refunds, and payment disputes are handled by Apple under its own terms. See reportaproblem.apple.com. I have no access to your payment details.

Your rights under the Australian Consumer Law

If you are a consumer in Australia, MusoHQ comes with guarantees that cannot be excluded under the Australian Consumer Law, including guarantees that it is of acceptable quality and reasonably fit for its ordinary purpose. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law where doing so would be unlawful. If any part of these terms would have that effect, that part does not apply.

Where the law allows me to limit my liability, my liability to you for failing to meet a consumer guarantee is limited to resupplying the app or paying the cost of having it resupplied.

What MusoHQ does not promise

Subject to the section above, MusoHQ is a calculation and record-keeping tool and I do not promise that it is free of bugs, or that any figure it produces, including GST, super guarantee, totals and payout splits, is correct for your particular circumstances. Tax and superannuation rules change, and rates and thresholds are built in as at the date of each release. Always check figures that matter before you rely on them, especially at tax time.

Acceptable use

Use MusoHQ for your own gigs, invoicing and record-keeping. Please don't copy, decompile, redistribute or resell the app. Nothing here limits anything you are permitted to do under the Copyright Act 1968.

Changes to these terms

If these terms change, this page will be updated and the date above will change. Changes apply from the date they are published, and only to your use of the app after that date.

A change will never reduce what you have already paid for. If you have unlocked MusoHQ Pro, that unlock stays yours on the terms that applied when you bought it. If you do not accept a change, you can stop using the app. Nothing in this section affects your rights under the Australian Consumer Law.

Governing law

These terms are governed by the law of New South Wales, Australia. This does not take away the benefit of any consumer protection law that applies where you live.
